NOTPAUL BID TERMS AND CONDITIONS

 

These Terms and Conditions are subject to, and incorporate by this reference, the NotPaul Terms of Use. Please read the following Terms and Conditions carefully as they represent a binding contract between you and NotPaul.

 

What happens to your NotPaul bid

 

NotPaul aggregates the demand from fans for a performer to play in a specific city or region. When you place a bid for an event on the NotPaul website, you are making a firm purchase offer and binding legal commitment for that ticket, subject to the following conditions:

a) The event is successfully scheduled within 90 days of the first bid for that event (the Confirm Deadline as stated on the event page for the applicable event); and

b) The event occurs within one hundred eighty (180) days of the first bid for that event (the Perform Deadline as stated on the event page for the applicable event).

 

Prior to the scheduling of the event you may edit your bid or withdraw your bid entirely. A submitted bid shall be considered in good standing only after the credit card information has been authorized and/or verified, including the billing address and other billing information. Submission of incorrect credit card information may delay or forfeit your bid. In such circumstances, a NotPaul representative will attempt to contact you. If NotPaul is unable to contact you, your bid may be canceled.

 

If the event is not scheduled within 90 days of the date of submission of the first bid for such event, the event and all corresponding bids shall be canceled. accordingly, you will NOT be charged for the event.

 

If, within ninety (90) days of NotPaul receiving the first bid for an event, (i) the event is successfully scheduled to take place within 180 days of NotPaul's receipt of the first bid and (ii) if you have a valid bid in good standing for the applicable event, then we will attempt to send you a notice via email with details for the scheduled event, including the date, time, actual ticket price, location, seat allocation (if applicable) and other terms and conditions applicable to your purchase, including the procedure for any cancellation contemplated by this paragraph. Upon transmission of such notification, you will have forty-eight (48) hours (as measured based on two (2) business days, which are Monday through Friday) to cancel your bid. By submitting your bid, you agree to access your email on a daily basis during the ninety (90) day period described in this paragraph. If you will not have regular daily access to your email during the ninety (90) day period described in this paragraph, you may not have an opportunity to cancel your bid as described above and will consequently purchase the ticket applicable to your bid subject to the terms and conditions in the notice of scheduled event without any opportunity to cancel.

 

If you do not cancel your bid, regardless of whether such failure to cancel is due to your failure to access your email during the forty-eight (48) hour cancellation period, then the credit card you have provided will be charged by NotPaul or by an independent agent (e.g. a ticketing company) retained by the event promoters or venue to ticket the applicable event. The amount charged will be less than or equal to the bid you placed for the event. in then event that your bid is processed incorrectly (i.e. incorrect pricing information or seat allocation), then notpual or the applicable event organizer will have the right to cancel the applicable ticket and refund you the applicable amount, regardless of whether the error was due to human error or system malfunction.

 

Who You Are Buying From


NotPaul typically partners with third parties such as ticketing vendors, venues, promoters, performers, their agents and the like ("Event Organizers"). The Event Organizers typically provide the events for which NotPaul is aggregating demand. NotPaul does not operate the events and cannot control unforeseen circumstances which may occur at an event. When you bid on an event through NotPaul, the ultimate Event Organizer is undetermined and is identified only when the event is actually scheduled. NotPaul may  facilitate the transaction and collection of payments on behalf of the Event Organizer. Alternatively, NotPaul may be required by the Event Organizer to delegate all or a portion of the responsibilities for all transactions and collection of payments to a designee of the Event Organizer. Generally, NotPaul is simply a demand aggregator with respect to the ticket sales and events. Accordingly, in most cases, you will be purchasing the tickets from the applicable Event Organizer.

 

The Event Organizers' policies generally prohibit NotPaul from issuing exchanges or refunds after a ticket has been purchased, including for destroyed, lost or stolen tickets.

 

All sales after the expiration of the applicable cancellation period are final. No refunds, no cancellations, no credits, no exchanges, and no transfers after consummation of the purchase will be made. Unforeseen circumstances beyond the control of NotPaul and/or the Event Organizers will not be grounds for a refund, including but not limited to the following: force majeure events such as weather conditions and natural disasters; access to events such as waiting in lines; personal circumstances such as family and medical emergencies; and the like. Event Organizers have the right to refuse entry to any ticket holder, without a refund, for any reason at their discretion, including but not limited to: disorderly behavior, intoxication, venue capacity, breach of security restrictions, violation of venue rules and breach of Event Organizers' terms and conditions. You hereby acknowledge that you are aware that the venue and acts are subject to change by Event Organizers. You hereby acknowledge that assurances, promotions, amenities and other terms and conditions promised by Event Organizers are not guaranteed by NotPaul and are not grounds for a refund.

 

Editing your bid

 

Once you receive a bid confirmation with a NotPaul bid ID, the information you submitted with your bid will have been logged in the NotPaul databases. You can log-in to your NotPaul account and edit your bid at any time prior to the event being scheduled. Once the event is scheduled, you have forty-eight (48) hours to cancel your bid as described above in these Terms and Conditions or your bid shall be accepted and final.

Canceled/Postponed Events

 

Because of how NotPaul works, it is unlikely that a scheduled NotPaul event will be canceled, but it may still happen. Occasionally, the performer/promoter/venue will need to cancel an event. Should this occur, we will attempt to contact you to inform you of refund or exchange procedures for that event. For exact instructions on any canceled or postponed event, please check the event information online or contact us.

 

If a refund is issued, you will most likely receive a credit from NotPaul or the appropriate ticketing agent to the credit card that you used to purchase that ticket. NotPaul typically only offers refunds and/or exchanges based on the applicable Event Organizer's instructions. In order to receive a refund or an exchange that may be offered, you will have to comply with the applicable Event Organizer's instructions and/or deadlines, which, along with the decision about whether or not to issue a refund or an exchange, may be at the Event Organizer's discretion.

When NotPaul issues you a refund for a ticket, it will issue a refund for the amount you paid for the ticket. In many cases, the Ticket Organizer's order processing fees and the like are non-refundable. If a refund is issued, it will be issued using the same method of payment that was used to purchase the tickets. If a credit card was used to make the refunded purchase, then only that actual credit card will receive the credit for the refund. NotPaul will not be liable for travel or any other expenses that you or anyone else incurs in connection with a canceled or postponed event.

If the event has been rescheduled or the venue changed, then the applicable Event Organizer may apply refund limitations. If an event is canceled, rescheduled, or the venue for the event changed, please email support@notpaul.com for information. Please include your bid ID number with any communication so we can quickly identify the applicable show.
