NotPaul, Inc and its family of related sites including, http://www.notpaul.com/ and http://www.notpaul.net/ (collectively, the "Site" or "Sites" or "NotPaul"), are dedicated to protecting the privacy of users of NotPaul. NotPaul's mission is to provide the most compelling online experience for fans of live events and performances and to achieve that objective we need to handle your information with care. Your use of the Sites constitutes your acceptance of this Privacy Policy and your consent to the practices it describes. This Privacy Policy covers NotPaul's treatment of personal information that NotPaul or its partners gather when you are on the Sites and when you use NotPaul services. This policy does not apply to the practices of third parties that NotPaul does not own or control, or to individuals that NotPaul does not employ or manage.
1. Types of Personally Identifiable Information Collected
While you visit NotPaul we may collect various types of personally identifiable information (PII). The types of information we may gather are described below.
Much of the personally identifiable information (PII) we receive comes directly from members who are interested in bringing great events to life by using NotPaul. We receive and store any information you enter on the Sites, provide to us in connection with registration for NotPaul services or provide to us in any other way. You can choose not to provide us with certain information, but then you may not be able to take advantage of many of our special features and services. The personal information you provide is used for such purposes as enabling your use of certain services, responding to your requests for certain products and services, customizing the advertising and content you see, and communicating with you about specials and new products. In order for you to use our Sites or services, you must complete a registration form. We require your contact information (such as name and e-mail address). We may also request demographic information and unique identifiers in order to provide you with a more personalized service. To process your orders, we require contact information (such as billing address) and credit card or other payment information. This information is used for billing purposes and to fill your orders. We collect personal information when you register, log on, or visit our Sites, including when you participate in activities on our Sites, such as by bidding, purchasing, reviewing, completing a user registration form or online survey, game, promotion, contest or sweepstakes.
b. Information From Others.
To help NotPaul serve you better and to improve our products and services, we may supplement personally identifiable information that we have collected directly from our customers with other information that we obtain from third parties or from our partners. In addition, we may obtain information about individuals who are not yet users of NotPaul. To insure your privacy when we associate information that we obtain from third parties with personally identifiable information that we have collected under this Privacy Policy, we will treat the acquired information like the information that we collected ourselves and, except as permitted by this Privacy Policy, the information will not be shared with other third parties.
c. Information Through Technology.
We receive and store certain types of information whenever you interact with us. NotPaul automatically receives and records certain "traffic data" on our server logs from your browser including your IP address, NotPaul cookie information, and the page you requested. NotPaul uses this traffic data to help diagnose problems with its server, analyze trends and administer the Sites and services.
Generally, our services automatically collect usage information, such as the numbers and frequency of visitors to our Sites and its components or usage data regarding our services, similar to TV ratings that indicate how many people watched a particular show. Such data is only used in the aggregate. This type of collective data enables us and our partners to figure out how often customers use parts of the Sites or the services, so we can make the Sites and services appealing to as many customers as possible. In addition, we may provide statistical information, not information about you personally, to our partners about how our customers, collectively, use our Sites and services. We share this type of statistical data so that our partners also understand how often people use their areas, services and our Sites, so that they, too, may provide you with an optimal web experience or services experience.
Many companies offer programs that help you to visit web sites anonymously. While NotPaul will not be able to provide you with a personalized experience if we cannot recognize you, we want you to be aware that these programs are available.
NotPaul also uses cookies. Cookies are alphanumeric identifiers that we transfer to your computer's hard drive through your Web browser to enable our systems to recognize your browser and tell us how and when pages in our Sites and services are visited and by how many people. NotPaul cookies do not collect personal information, and we do not combine information collected through cookies with other personal information to tell us who you are or what your screen name or email address is. The "help" portion of the toolbar on the majority of browsers will direct you on how to prevent your browser from accepting new cookies, how to command the browser to tell you when you receive a new cookie, or how to fully disable cookies. Some of our business partners may use cookies on our Sites (for example, advertisers) or in connection with our services. However, we have no access to or control over these cookies and do not accept any responsibility for such use.
The NotPaul Sites may use other technical methods for tracking purposes, including web beacons. Web beacons are small pieces of data that are embedded in images on the pages of Sites. We may use these technical methods to analyze the NotPaul traffic patterns, such as the frequency with which our users visit various parts of our Sites. These technical methods may involve the transmission of information either directly to us or to another party authorized by us to collect information on our behalf. We also use these technical methods in HTML emails that we send our customers to determine whether customers have opened those emails and/or clicked on links in those emails. The information from use of these technical methods may be collected in a form that is personally identifiable.
The NotPaul Sites may include advertising from 3rd parties and links to other web sites. We do not provide any PII to these network advertisers. Advertisers who place advertisements on our Sites, or third parties with whom NotPaul has a relationship, may use their own cookies and web beacons to collect non-personally identifiable information. It may not be apparent that this information is being collected so, once you have clicked on an advertisement and have left our Sites, our Privacy Policy no longer applies and you must read the privacy policy of the advertiser to see how your personal information will be handled on their site. You should contact these 3rd party advertisers and websites directly if you have any questions about their use of the information that they collect.
2. USE OF COLLECTED INFORMATION
NotPaul may use PII to augment the company's operations such as improving and personalizing the NotPaul website experience, establishing and verifying the identity of users; opening, maintaining, administering and servicing user accounts; processing, servicing or enforcing transactions and sending related service communications; communicating to users with promotional notices and offers; responding to users questions, inquiries, comments and instructions; and maintaining the security and integrity of our systems. NotPaul may also use personally identifiable information to provide offers, promotions and product updates to you via standard mail.
NotPaul is a platform for posting and sharing content, some of which is intended ultimately for public performance. Any information or content submitted may be used by NotPaul or its affiliates to provide other users with reviews, event information, performer information and so on. If you do post content or submit material, and unless we indicate otherwise, you grant NotPaul a nonexclusive, fee-free, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant NotPaul the right to use any username or home town that you submit in connection with such content.
Your email address may be used by NotPaul or any subsidiary, parent or other corporation into which NotPaul merges or is otherwise acquired or sold, in whole or in part. NotPaul may use your email address for processing, servicing or enforcing transactions and sending related service communications; providing users with service or product updates, promotional notices and offers; and/or responding to your questions, inquiries or comments.
If you choose to use our referral service to tell a friend about our Site, we will ask you for your friend's name and email address. We will automatically send your friend a one-time email inviting him or her to visit the Site. NotPaul stores this information for the sole purpose of sending this one-time email and tracking the success of our referral program. Your friend may contact Customer Service to request that we remove this information from our database.
NotPaul and its event organizers (e.g, ticketing vendors, venues, promoters, performers and the like) share information about you for the purposes of fulfilling your successful bids. This may include using your billing and payment information, your email address and shipping information and other contact information for purposes of processing, servicing or enforcing transactions and sending order status and other related communications.
d. Use by Other Third Parties.
Sometimes NotPaul hires companies to help deliver messages or services, such as a company that enables all or a portion of our services or assists us in the analysis of consumer data, development of new services, sending email, sending catalogs or other promotional mailings; or providing customer assistance or marketing assistance. In those instances, there is a need to share your information with these companies. Sometimes NotPaul also works with other companies who help either gather your information or communicate with you. Your opt-out choices under paragraph 3 below will not apply to sharing by NotPaul of your personal information with any of these companies. We require these third parties to maintain your information in strictest confidence and to ensure they honor the privacy settings you have selected for the handling of your private information. Nonetheless, except as separately permitted by other provisions of this Privacy Policy, these companies are allowed to gather, receive, and use your information only for the purposes described in this paragraph or as required by law. The personal identifiable information that may be shared is more fully described in paragraph 1a. above.
e. No Sharing with Third-Party Marketers.
We do not rent to, or share your personal information with third-party marketers without first obtaining your consent. Should this policy change in the future, NotPaul will post a notification of those changes to the homepage and other places NotPaul deems appropriate.
f. Social Portability, Google OpenSocial and Facebook Beacon
NotPaul may enable its Site for compatability with social network portability applications such as Google OpenSocial, Facebook Beacon or similar services. These tools allow you to share your NotPaul actions easily with friends on your social network of choice. Use of such tools will require you to maintain an account with these 3rd party services and for you to observe the terms, conditions, and policies of those sites. This data will only be transferred by explicit action on your part authorizing NotPaul to initiate a transfer of some recorded action (such as bidding on an event) to members of your social network.
3. YOUR OPTIONS
As stated previously, you can always opt not to disclose information, even though it will be needed to make a purchase or take advantage of certain NotPaul features.
Finally, if you do not exercise your opt-out choices upon registration or initial log-in at our Sites, it may take up to ten (10) days for your opt-out choices to be fully effective. As our systems require time to update, promotional mailings using personal information shared before you opt-out may already be in process. Thus, you might continue to receive promotional materials from NotPaul based upon the personal information you have provided under this Privacy Policy for up to ten (10) days. For similar reasons, your personal information might continue to be shared with third parties for promotional purposes for up to ten (10) days.
4. SECURITY MEASURES
Your NotPaul Account Information is protected by a password for your privacy and security. You need to work to protect against unauthorized access to your password and to your computer by signing off once you have finished using a shared computer.
We have put in place physical, electronic, and managerial procedures to safeguard and help prevent unauthorized access, use or disclosure, maintain data security, and correctly use the information we collect online or via the NotPaul services. Internally, access to customers' personal information is restricted closely according to job function and necessity. All employees are kept up to date on our security and privacy practices. Finally, the servers that store personally identifiable information are kept in a secure, guarded environment. However, we do not guarantee or assure security and such risks cannot be eliminated; thus, you are reminded to not store sensitive information (such as Social Security Numbers and other sensitive financial information) on the Sites or NotPaul services.
5. ACCESS TO YOUR INFORMATION
You can access and update the contact information you gave us during registration or bidding by going to My Account. You also may edit a bid before an event has been confirmed by visiting My Account. If you have elected to store your credit card information with us, we only display the last few digits of your credit card number in the saved payment methods in the My Account section. If you have forgotten your password, there are instructions on the link above to help you recover your password. If you need to recover your password, you can also contact us via email at notifications@notpaul.com using the email address you used to register with the Site.
6. MISCELLANEOUS
NotPaul does not sell products for purchase by children. We sell children's products for purchase by adults. If you are under 18, you may use NotPaul only with the involvement of a parent or guardian. We may release personal information when we believe in good faith that release is necessary to comply with that law; or to respond to subpoenas or warrants served on NotPaul or its partners (or any of their subcontractors); enforce or apply our conditions of use and other agreements; or protect the rights, property, or safety of NotPaul, its partners (or their subcontractors), our employees, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction. NotPaul may amend this Privacy Policy. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used. If we make material changes to our privacy policy, we will notify you by posting an announcement on our Sites so you are always aware of what information we collect, how we use it, and under what circumstances if any, it is disclosed.
